Answers: As long as the pointer originate from the US and was not import as a 3B then your fine. Technically even a class 4 is legitimate in the states assuming you use it responsibly. Stargazing is not the best thought to use it for as even an accidental aircraft incident is a felonious offense and have a mandatory prison sentence.
